The section

Who pays, and what the charge sits on

Charged on all categories of property other than agricultural land, outside the limits of a rating area, abutting a national or provincial highway or lying within the area of a motorway, in such limits and lengths as the Government notifies. Administered and regulated under the Punjab Urban Immovable Property Tax Act 1958.

Due from the owner or the occupant, jointly and severally. It is charged in addition to any other tax on the property and is the first charge upon the property unit.

The Government may by gazette notification exempt any property unit, person or class from the whole or part of the tax, on whatever conditions it specifies. Check for a notification covering your stretch before relying on this.

Exemptions

What the tax does not reach

The published text reads 'Annual Taxable Value of which does not exceed rupees five hundred thousand belonging to a widow, a divorcee, a disabled person, a minor orphan or a female unmarried orphan upto the age of twenty five years'. The value ceiling and the class of person are one condition, not two separate exemptions — a low value alone does not exempt a property, and nor does the owner's status alone.

Reading the result

Location on a notified road is the whole test

This is not a general property tax. It reaches property abutting a notified stretch of highway or motorway outside urban limits, which means two neighbouring plots can be treated differently if only one fronts the notified road.

Before calculating anything, establish whether the specific stretch is notified. Being near a motorway is not the test; abutting a notified section is.

Commercial frontage is the usual target

The charge tends to catch petrol stations, marriage halls, warehouses, restaurants and similar businesses that derive their value from highway access. That is the logic of the levy — it charges for the commercial benefit of the frontage.

It does not replace ordinary property tax

Property outside urban limits may be outside the annual property tax rating area while still being caught by this. Equally, a property inside a rating area can face both. One demand does not imply the other has been settled.

Where this stops

Annual Taxable Value is an assessed figure from the department's valuation, not your own estimate of rental worth. This applies the rate to the value you enter; the assessment behind that value is where most disputes actually sit.

FAQs

Punjab Highways Property Tax FAQs

Which properties does this tax reach?

Property that is outside the limits of a rating area, is not agricultural land, and abuts a national or provincial highway or lies within a motorway area — in the limits and lengths the Government has notified. All three have to hold. Property inside a rating area is assessed to urban immovable property tax instead.

What is the rate?

Five per cent of the Annual Taxable Value of the property unit. It is a flat rate with no bands and no slicing.

What counts as Annual Taxable Value?

The value of a distinct property unit excluding the value of any machinery. It is the same concept the Punjab Urban Immovable Property Tax Act 1958 uses, and this tax is administered under that Act.

Who has to pay — the owner or the tenant?

Both, jointly and severally. The department can recover from either, and the tax is the first charge upon the property unit.

Is it charged instead of property tax or on top?

On top. The section says it is levied in addition to any other tax charged under any other law for the time being in force.

Does a low Annual Taxable Value exempt me?

Not on its own, and this is the most commonly misread part of the section. The exemption is a single condition with two limbs: an Annual Taxable Value of Rs 500,000 or less AND an owner who is a widow, a divorcee, a disabled person, a minor orphan or an unmarried female orphan up to the age of 25. A low value alone does not exempt a property, and nor does the owner's status alone.

What else is exempt?

Buildings and land owned by the Federal or a Provincial Government, and property used exclusively by the public for worship.

Can the Government exempt my property separately?

Yes. It may by notification in the official Gazette exempt any property unit, person or class from the whole or any part of the tax, on whatever conditions and limits it specifies. Check whether a notification covers your stretch before relying on this.

How do I know whether my stretch of road is notified?

You cannot tell from the road itself — the section applies only to the limits and lengths the Government has notified, which are set separately. Ask your Excise and Taxation Officer whether your property unit falls within a notified stretch.

Is this the amount I will be billed?

It is five per cent of the value you entered. The demand your Excise and Taxation Officer raises governs, and it turns on the Annual Taxable Value the department has recorded for your property unit.
